These Terms of Service ("Terms") govern your use of the Cognicard application ("the app"), developed by Jeremy Peronto. By using the app, you agree to these Terms.
1. Use of the App
Cognicard is a flashcard and study tool designed to help you learn and retain information. You may use the app for personal, non-commercial study purposes. You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the app
- Use the app to generate harmful, abusive, or inappropriate content
- Circumvent any usage limitations or access controls
2. Subscriptions
Cognicard offers optional paid subscriptions (Pro and Premium) that unlock additional features such as AI voices, unlimited card generation, and advanced review modes.
- Billing: Subscriptions are billed through your Apple ID account via the App Store. Payment is charged at confirmation of purchase.
- Renewal: Subscriptions auto-renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
- Management: You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.
- Price changes: Prices may change. You will be notified in advance through Apple, and changes apply to the next billing cycle.
3. AI-Generated Content
Cognicard uses artificial intelligence (OpenAI) to generate flashcards and evaluate answers. AI-generated content may contain inaccuracies. You are responsible for reviewing and verifying the accuracy of generated flashcards before relying on them for study.
4. Your Content
You retain ownership of all content you create or import into the app, including notes, flashcards, and images. By using AI features, you grant us permission to send your content to OpenAI's API solely for the purpose of generating flashcards or evaluating answers.
5. Privacy
Your use of the app is also governed by our Privacy Policy, which describes how your information is handled.
6. Intellectual Property
The app, including its design, code, and branding, is the intellectual property of Jeremy Peronto. You may not copy, modify, or distribute the app or its components except as permitted by these Terms or applicable law.
7. Disclaimer of Warranties
The app is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:
- The app will be error-free or uninterrupted
- AI-generated content will be accurate or complete
- The app will meet your specific learning requirements
8. Limitation of Liability
To the maximum extent permitted by law, Jeremy Peronto shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of data or academic outcomes.
9. Termination
You may stop using the app at any time by uninstalling it. We reserve the right to modify or discontinue the app at any time without notice.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected by updating the "Effective Date" at the top of this page. Continued use of the app after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
